Arrest
You have been pulled over for a DUI and the officer has just
indicated that he is placing you under arrest for a DUI. What is
an arrest? Arrest is defined as when a person is stopped from his
normal activities by virtue of legal authority by detaining him.
In essence, the person is deprived of his liberty. When a person is
arrested for a DUI, the police officer's will handcuff you and place
you in the rear of the squad car. You will be transported to the police
station for processing. However, once you are arrested, you will have
various rights that will apply.
You will have your Miranda rights read to you. If the officers fail
to inform you of these constitutional rights, your statements could potentially
be inadmissible. If they fail to inform you of these rights does not cause
the charge of DUI to be dismissed.
