Blood Evidence
Law Enforcement officials in DUI Arrests typically offer the driver a breath, blood or urine test
to determine the level of alcohol or drugs in the person's system. In some states, when a driver
passes one test, of if the Breathalyzer is not working, the officer is permitted to request another
test. If the driver refuses the next text, it is commonly regarded as a refusal and the driver's
license is suspended accordingly.
In many states, accepting the test and registering a .08 or greater BAC will result in a license
suspension. If the driver refuses the test, the suspension is often double that if it had been
accepted.
Blood tested evidence is typically considered more reliable than breath tests, but that isn't always
