Home Detention
If you have been convicted of a DUI, there are numerous sentencing options available to the judge. The
judge may order you to home detention. Home detention is a court order directing you to stay within the
confines of your residence.
This sentence is much more palatable then being ordered to serve a jail sentence. Judges typically give
a sentence of home detention when the jails are overcrowded. However, do not leave your residence during
this sentence as judges will become very upset. Judges would revoke your sentence and resentence you to jail.
An additional sentence available to the sentencing judge is work release. Work release is a jail sentence
where a person is allowed to leave the jail for employment. A person would not lose his job as a result
of being incarcerated in the county jail. Typically, counties will charge the person for the privilege of
work release.
SCRAM devices are available as a sentencing alternative. The judge will order you not to consume alcohol
and attach a device to monitor alcohol use. These devices are attached to your body and will alert the
authorities if you consumed alcohol. If you violate the terms of the SCRAM sentence, the judge will
typically sentence you to jail.
