Sentencing Hearing
If you have been convicted of a DUI by a judge, jury or through a guilty plea, there
may be a sentencing hearing.
A sentencing hearing is a hearing in which the judge determines what sentence to impose.
The state will have an opportunity to present evidence in aggravation. The aggravation
includes your prior criminal history, potentially the facts in your DUI and other relevant material.
You will have an opportunity to present evidence in mitigation. The mitigation will include
your lack of criminal record, your good attributes and other evidence that will paint you in a
positive light. The judge will listen to recommendations regarding the sentence.
In all DUI charges, there are mandatory minimums that typically apply with the charge. Sentences
can vary greatly depending upon which judge is conducting the sentencing hearing.
